Job Description:

Reporting to the Unit Manager Appeals & Prosecutions, this position is responsible for providing accurate and specialist knowledge and advice to Council staff, management, Council lawyers and customers on prosecution related matters. The role will develop systems, documented procedures, processes and guidelines and develop and maintain a prosecution framework.
This position is responsible for organisational wide enforcement and lodgement of various Acts, preparation of briefs of evidence in relation to prosecutions at the Magistrates Court and Victorian Civil and Administrative Tribunal (VCAT), and will formally represent Council as a prosecutorial advocate in the Magistrates’ Court and VCAT where Council is authorised to take criminal or quasi-criminal prosecution or enforcement action, under relevant legislation.
The position will be responsible for all Fines Victoria lodgements and management of Councils current infringement debt position developing processes to ensure effective lodgement increasing the rate of payment of outstanding infringements, furthermore, will be responsible for the management and coordination of all prosecution accounts, judiciary correspondence and account reconciliation

Job Requirements:

  • Strong understanding of relevant Acts relating to Local Government enforcement activities, Council’s Local Law, prosecutions issues and emerging trends and how these should effectively be addressed.
  • Excellent written and verbal administration and communication skills.
  • Ability to provide accurate and specialist knowledge and advice to Council staff, management, Council lawyers and customers.
  • Ability to write, develop, review and consult on clear, high standard documents relating to the prosecutions and the legal field

Qualification & Experience:

  • Strong computer literacy and experience in writing strategic documents, guidelines and plans.
  • Strong understanding with extensive experience of legal processes, including court procedures, practices and prosecution of cases before the Magistrates Court, and the ability to prepare legal documents and prosecutions using legal terminology.
  • Experience working independently to effectively represent Council in the Magistrates Court and VCAT and make judgments at such hearings in a timely manner appropriately and effectively
  • Formal qualifications in legal studies or law enforcement/legislation, combined with substantial relevant experience.
